Important Client Notice: These Terms and Conditions govern all landscape design, construction, and garden services provided by OE Landscapes. Please review carefully prior to signing your project acceptance or paying any project deposit.

1. Quotations and Contract Formation

  • Validity: Written quotations are valid for 30 calendar days from the date of issue unless otherwise specified in writing.
  • Acceptance: A binding contract is formed when the Client provides written acceptance of the quotation (or signs the project proposal) and pays the required Booking Deposit.
  • Scope & Variations: All work will strictly conform to the scope outlined in the agreed quotation. Any requested changes, additions, or reductions to the project scope (“Variations”) must be agreed in writing. OE Landscapes will issue a formal Variation Order detailing cost adjustments and timeline revisions before extra work commences.

2. Payment Terms and Material Deposits

  • Booking Deposit: A non-refundable booking deposit of [Insert %] of the total quoted project value is required upon contract signing to reserve project dates within our operational schedule.
  • Material Deposit: For projects requiring specialised, bespoke, natural stone, heavy aggregates, or pre-ordered plant nurseries, a Material Deposit equal to 100% of the material costs is due prior to order placement.

Material Deposit & Cancellation Rules

Material deposits are non-refundable to the extent of expenses already incurred by OE Landscapes. If the Client cancels the contract after materials have been ordered, OE Landscapes will retain the portion of the deposit required to cover non-refundable supplier costs, restocking fees, and haulage charges. Delivered materials paid for in full by the Client remain the property of the Client and will be made available for collection or site delivery at the Client’s expense.

  • Interim Stage Payments: For larger projects exceeding 14 calendar days, interim milestone payments will be scheduled as outlined in the project quotation (e.g. groundworks completion, hardscaping stage).
  • Final Invoice & Late Fees: The final balance is due strictly within 7 calendar days of practical completion. OE Landscapes reserves the right to charge statutory interest on overdue accounts under the Late Payment of Commercial Debts (Interest) Act 1998 at 8% plus the Bank of England base rate.

3. Site Access and Client Obligations

  • Site Access: The Client shall grant clear, uninterrupted access to the site during normal working hours (typically 08:00 to 17:00, Monday through Friday).
  • Utilities: Free access to a continuous mains supply of water and electricity must be made available to OE Landscapes for the duration of the project.
  • Underground Services & Hazards: The Client is responsible for informing OE Landscapes of the location of all underground services, including water pipes, electrical cables, gas lines, and drainage. OE Landscapes accepts no liability for damage caused to unmarked or incorrectly mapped underground utilities.

4. Materials, Plants, and Natural Variations

  • Natural Variations: Natural materials such as timber, sandstone, granite, and porcelain are subject to natural variations in tone, vein patterns, grain, and surface texture. Samples provided serve as a guide only and exact uniformity cannot be guaranteed.
  • Planting & Living Stock: Once plants, trees, and turf have been installed, ongoing care, irrigation, and maintenance become the sole responsibility of the Client. OE Landscapes provides no warranty on plant survival post-handover, as plant health depends on external environmental factors and proper watering.
  • Title to Goods: All materials delivered to the site remain the legal property of OE Landscapes until all outstanding invoices are settled in full.

5. Weather, Delays, and Termination

  • Force Majeure & Weather: OE Landscapes is not liable for project delays caused by severe weather conditions (e.g. ground frost, heavy rainfall, flood), supplier stock shortages, or other unforeseen events beyond reasonable control.
  • Client Cancellation: If the Client cancels the contract within 7 calendar days of the agreed project start date, the Client shall be liable for all reasonable expenses incurred, including labour booking preparation and supplier restocking penalties.
  • Company Termination: OE Landscapes reserves the right to suspend or terminate services if the Client fails to meet agreed payment schedules or creates an unsafe working environment.

6. Warranty, Insurance, and Liability

  • Workmanship Guarantee: OE Landscapes provides a 12-month workmanship warranty on all structural hard landscaping (e.g. paving, retainers, decking, masonry). This guarantee excludes natural ground settlement, extreme weather damage, general wear and tear, or third-party interference.
  • Public Liability: OE Landscapes maintains comprehensive Public Liability Insurance. We accept responsibility for property damage caused directly by our proven negligence, but accept no liability for pre-existing structural defects.

7. Dispute Resolution

In the event of any query or dispute regarding the standards of workmanship or billing, both parties agree to enter into good-faith negotiations to achieve an amicable resolution. If unresolved within 21 days, the dispute shall be referred to independent mediation or the relevant Small Claims process under English law.
